We did make sure that AppSumo included an "Available for new accounts or non-Pro accounts only." notice on their site, as well as a link to the Remember The Milk terms in the offer description. I'll pass on your feedback about making this more prominent to the AppSumo team.

I addressed the blog post to non-Pro folks as a good opportunity to grab a Pro account as part of the bundle ("Been thinking about going Pro?"), but I've now also added a note to the post to be extra clear that this offer is specific to new and non-Pro accounts.
