Estimated total time for smart list includes ALL subtasks

I've just noticed some strange behaviour (ie. not what I would have expected) in the totalling of estimated time.
I have a smart list to capture everything that's due today, overdue or P2 (which I'm using as a way to mark tasks I WANT to do today even if not 'due').
One of the P2 tasks has a number of subtasks, some of which are due in the future. All the subtasks have 'no priority' - so if they were on their own they wouldn't get picked up in the smart list.
However the total estimated time for the smart list includes the time estimates for ALL subtasks - even ones due in the future.
Is there any way to stop these being included?
